SCOPIYA — TERMS & CONDITIONS

Welcome to SCOPIYA — Creating Scope for Everyone.

SCOPIYA is a platform that aims to connect people and organisations with opportunities, talent and service providers. Depending on the category, SCOPIYA may act as a facilitator, referral platform, recruitment intermediary or casting/talent intermediary.

These Terms & Conditions (“Terms”) govern your use of the SCOPIYA website, platform and related services.

By registering, submitting information, posting a requirement, applying for an opportunity, accepting a referral, or otherwise using SCOPIYA, you agree to these Terms.

If you do not agree with these Terms, please do not use SCOPIYA.

1. ABOUT SCOPIYA

SCOPIYA is a connecting and facilitation platform.

Our role may include helping:

  • Job seekers discover employment opportunities and employers find suitable candidates.
  • Customers find independent service providers.
  • Artists discover talent-related opportunities.
  • Filmmakers, producers, directors, casting professionals and other industry participants discover artists and talent.

Unless expressly stated otherwise, SCOPIYA is not the employer, service provider, production house, casting agency, contractor or principal party to the underlying arrangement between users.

The actual terms of employment, service, assignment, casting engagement or other arrangement are generally decided directly between the relevant parties.

SCOPIYA may facilitate introductions, communication, screening, coordination, referrals or other support depending on the category and arrangement.

2. USER ACCOUNTS & INFORMATION

Users are responsible for providing information that is accurate, current and not misleading.

You must not:

  • impersonate another person;
  • create an account using false information;
  • submit fraudulent applications or requests;
  • upload malicious files;
  • harass, threaten or abuse other users;
  • misuse another person's personal information;
  • attempt to access another person's account;
  • upload material that you do not have the right or permission to share; or
  • use SCOPIYA for unlawful purposes.

You are responsible for keeping your login credentials secure and must not share passwords, verification codes or other account-security information.

SCOPIYA may restrict, suspend or close accounts where reasonably necessary to protect users, investigate misuse, comply with law or maintain the integrity of the platform.

3. JOBS — JOB SEEKERS & EMPLOYERS

3.1 SCOPIYA's role

For employment opportunities, SCOPIYA acts as a recruitment intermediary/referral platform connecting employers with potential candidates.

SCOPIYA is not the employer of candidates referred through the platform, unless a separate written arrangement expressly states otherwise.

SCOPIYA may review candidate information, screen candidates, communicate with employers and refer candidates according to the requirements provided by the employer.

3.2 Employer responsibilities

Employers are responsible for providing accurate information regarding:

  • position;
  • qualifications;
  • experience;
  • salary or salary range;
  • duties;
  • location;
  • working hours;
  • employment conditions; and
  • other relevant requirements.

The employer is responsible for making the final hiring decision and for the employment relationship after selection.

3.3 Candidate responsibilities

Job seekers are responsible for providing truthful information regarding their qualifications, experience, identity and other relevant details.

Registration, application, interview or shortlisting does not guarantee employment or selection.

Candidates should independently review the employer, position and proposed employment conditions before accepting an offer or sharing sensitive documents.

3.4 Employment terms

Salary/remuneration, duties, working hours, work location, leave, benefits, employment duration, probation/evaluation arrangements and other employment conditions shall be mutually agreed between the employer and candidate.

SCOPIYA does not determine these employment conditions unless specifically agreed in writing for a particular recruitment assignment.

3.5 Candidate fees

Unless specifically stated otherwise for a lawful and separately agreed service, SCOPIYA does not charge job seekers a recruitment or registration fee for being referred to an employer.

3.6 Employer recruitment/referral fee

Where SCOPIYA and an employer have agreed to a recruitment/referral fee, the fee is payable by the employer according to the specific commercial terms agreed between SCOPIYA and that employer.

Such commercial terms may vary according to the position, recruitment assignment and agreement.

3.7 Evaluation and replacement

Where an employer-specific recruitment agreement provides for an evaluation period or replacement arrangement, those specific terms shall apply to that recruitment assignment.

For example, an agreed initial evaluation period may allow the employer to assess a candidate's suitability while the candidate remains entitled to payment for work actually performed.

Any replacement commitment by SCOPIYA will be subject to the terms of the applicable employer agreement and availability of a suitable candidate.

3.8 No guarantee of employment

SCOPIYA does not guarantee that:

  • a job seeker will receive employment;
  • an employer will hire a referred candidate;
  • a vacancy will remain available;
  • an employer will continue an employment relationship; or
  • a particular salary or career outcome will be achieved.

4. SERVICES — CUSTOMERS & SERVICE PROVIDERS

4.1 SCOPIYA's role

SCOPIYA may connect customers with independent service providers for various local or professional services.

Unless expressly stated otherwise, SCOPIYA does not itself perform the service and is not the employer of the service provider.

4.2 Direct arrangement between customer and provider

The customer and service provider are responsible for discussing and agreeing upon:

  • scope of work;
  • price;
  • materials;
  • timing;
  • location;
  • payment;
  • completion requirements;
  • warranty, if any; and
  • other conditions of the service.

4.3 Payment

Unless otherwise specified, the customer pays the service provider directly for the agreed service.

SCOPIYA does not automatically receive or hold the customer's service payment.

Where a referral fee is applicable, the service provider shall pay SCOPIYA according to the applicable referral arrangement communicated or agreed with the provider.

4.4 Provider responsibilities

Service providers must:

  • provide accurate information about their skills and experience;
  • maintain accurate availability and contact information;
  • communicate honestly with customers;
  • perform agreed work professionally;
  • use customer information only for legitimate purposes connected with the assignment;
  • comply with applicable laws and safety requirements; and
  • not misuse a customer lead obtained through SCOPIYA.

4.5 Customer responsibilities

Customers should:

  • provide accurate information about the required service;
  • communicate the requirements clearly;
  • agree the price and scope before work begins;
  • make payments according to the agreed arrangement; and
  • treat service providers fairly and respectfully.

4.6 Verification

SCOPIYA may review or verify information submitted by service providers.

However, registration, approval, verification or listing on SCOPIYA does not constitute a guarantee of the provider's skill, conduct, reliability, availability or future performance.

Where SCOPIYA uses a term such as “Verified”, the scope of that verification may be limited to the particular information or documents stated by SCOPIYA.

4.7 No guaranteed work or income

Registration as a service provider does not guarantee any minimum number of customers, assignments, income or earnings.

5. TALENT — ARTISTS & TALENT OPPORTUNITIES

SCOPIYA may provide a platform for artists and creative professionals to create profiles and discover opportunities.

Artists may include actors, models, dancers, singers, performers, writers, technicians, creators and other creative professionals.

5.1 Artist responsibility

Artists are responsible for ensuring that their profiles, photographs, portfolios, resumes, showreels, qualifications, experience and other information are truthful and that they have the right to submit such material.

5.2 Opportunities

SCOPIYA may display or communicate opportunities received from employers, clients, production companies, agencies, casting professionals or other parties.

Submission of an artist's profile, audition or portfolio does not guarantee selection, employment, payment or future work.

5.3 Direct engagement

Where an artist is selected for an assignment, the artist and the relevant client, employer, production company, agency or other party shall determine the applicable work terms, remuneration, schedule, usage rights and other conditions.

SCOPIYA is generally a facilitator/intermediary and is not automatically a party to that underlying engagement.

5.4 No guarantee of opportunities

Registration or approval of an artist profile does not guarantee auditions, casting opportunities, assignments, employment or income.

6. CASTING — ARTISTS (INCLUDING ACTORS), CASTING PROFESSIONALS & FILMMAKERS

Casting is a separate category from general jobs and talent opportunities.

SCOPIYA may connect artists with filmmakers, directors, producers, casting directors, casting companies, agencies, recruiters and other persons or organisations looking for talent.

6.1 Casting opportunities

SCOPIYA may facilitate auditions, casting calls, introductions, profile submissions or other casting-related opportunities.

Being contacted, shortlisted, invited to audition or participating in an audition does not guarantee selection or engagement.

6.2 Casting decisions

Final casting decisions are made by the relevant filmmaker, producer, director, casting professional, production company or other authorised party.

SCOPIYA does not guarantee that an artist will be selected.

6.3 Casting fees / commission

Depending on the specific casting arrangement, SCOPIYA may receive a commission or service/referral fee from:

  • the artist;
  • the filmmaker;
  • director;
  • producer;
  • casting company;
  • agency;
  • recruiter; or
  • another party involved in the casting or talent engagement.

The applicable fee, if any, may vary according to the particular assignment and shall be communicated or agreed before the relevant paid service or engagement where applicable.

A casting opportunity does not automatically mean that an artist must pay a commission or fee.

In some arrangements, the casting company or casting professional may be engaged and paid by a production house, filmmaker, producer or other client to conduct the casting process. In such cases, no artist commission may be applicable.

6.4 No guarantee against selection

Payment of any legitimate casting-related service or commission, where applicable, does not guarantee selection, a role, employment, screen time, future assignments or any particular outcome.

SCOPIYA does not guarantee that an artist will receive a role merely because their profile has been submitted or an audition has been arranged.

6.5 Transparency

Where a fee or commission is applicable to an artist, the applicable amount or basis of calculation should be communicated before the artist agrees to the relevant paid arrangement.

Artists should ask for clarification about any fee, commission, service charge or other payment before making a commitment.

7. CONTENT, PHOTOGRAPHS & USER MATERIAL

Users may upload resumes, photographs, portfolios, videos, descriptions, professional information and other material where the relevant feature allows it.

Users confirm that they have the necessary rights or permission to submit such material.

Users must not upload:

  • material belonging to another person without permission;
  • fraudulent documents;
  • malicious files;
  • unlawful content;
  • misleading professional information; or
  • content that violates another person's privacy or intellectual-property rights.

SCOPIYA may remove content that violates these Terms or applicable law.

8. PRIVACY & PERSONAL INFORMATION

SCOPIYA may collect and process personal information necessary to operate the platform and facilitate the relevant opportunity, job, service, talent or casting request.

Depending on the category, information may need to be shared with the relevant employer, customer, service provider, casting professional, filmmaker, producer, recruiter or other participant for the purpose of providing the requested service or opportunity.

SCOPIYA will handle personal information according to its Privacy Policy and applicable law.

Users should not upload sensitive personal information unless it is reasonably necessary for the relevant purpose and they have the right to provide it.

Users must not misuse another person's personal information obtained through SCOPIYA.

9. COMMUNICATIONS & FEEDBACK

By using SCOPIYA, users may receive operational communications necessary for:

  • account verification;
  • applications;
  • job or service requests;
  • referrals;
  • assignments;
  • auditions;
  • casting opportunities;
  • appointment updates;
  • feedback; and
  • support.

Operational communications are different from unrelated promotional marketing.

Users should provide honest feedback based on their own experience and should not include another person's confidential or sensitive information in feedback.

10. THIRD-PARTY RELATIONSHIPS

SCOPIYA may connect users with independent employers, customers, service providers, artists, casting professionals, filmmakers, producers, recruiters or other third parties.

SCOPIYA does not automatically become a party to the agreement between such parties.

Users should independently verify information that is important to their decision before entering into an employment, service, commercial, casting or other arrangement.

11. DISCLAIMERS

SCOPIYA aims to provide useful opportunities and connections, but does not guarantee:

  • availability of a particular opportunity;
  • selection for a job, service, role or casting;
  • quality or outcome of a third-party service;
  • performance of an employer, customer, provider, artist or other user;
  • payment by another user;
  • minimum income or work;
  • continued availability of a vacancy or assignment; or
  • any particular commercial, professional or creative result.

Website content, listings and user-submitted information may occasionally contain errors or require updating.

SCOPIYA may correct, modify, suspend or remove listings or platform features when reasonably necessary.

11.1 Post-Connection Conduct and Unlawful Activities

SCOPIYA acts as a connecting and facilitation platform and is not responsible for the independent actions, conduct, decisions or activities of employers, employees, customers, service providers, artists or other users after a connection is established.

If any user engages in illegal, fraudulent, dishonest or antisocial activities after receiving employment, work, service or other opportunities through SCOPIYA, the concerned user shall be responsible for such activities and their consequences. SCOPIYA may restrict or terminate access and may cooperate with lawful investigations where appropriate.

11.2 Changes in Work Type, Duties or Engagement Terms

SCOPIYA is not responsible if an employer, employee, customer, service provider, artist or other user independently changes the agreed work type, duties, responsibilities, working conditions, location, payment terms or nature of engagement after the connection has been established.

The concerned parties are responsible for clearly discussing and agreeing to any changes. SCOPIYA should be informed of material changes where relevant, particularly where such changes may involve misrepresentation, safety concerns or unlawful activity.

11.3 Theft, Damage, Loss and Other Harm

SCOPIYA is not responsible for theft, loss, property damage, financial loss, personal injury, misconduct or other harm arising from the independent actions or omissions of users, employers, employees, customers, service providers, artists or other third parties.

The concerned parties remain responsible for their own conduct, property, agreements and legal obligations. Users are encouraged to conduct appropriate verification and take reasonable precautions before entering into any employment, service, casting or other engagement.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

12. USER-TO-USER DISPUTES

Where a dispute arises directly between two users—for example:

  • employer and candidate;
  • customer and service provider;
  • artist and filmmaker;
  • artist and casting professional; or
  • any other connected parties—

the parties should first attempt to resolve the matter directly.

SCOPIYA may assist with communication or information where reasonably possible, but unless SCOPIYA has separately agreed to a specific responsibility, SCOPIYA is not automatically responsible for resolving the underlying dispute.

Nothing in these Terms removes any right or remedy that cannot legally be excluded.

13. PROHIBITED USE

SCOPIYA must not be used to:

  • conduct unlawful activities;
  • post fraudulent jobs or service requests;
  • solicit or exploit users for illegal purposes;
  • discriminate unlawfully;
  • harass or threaten another person;
  • collect personal information for unauthorised purposes;
  • distribute malware or malicious files;
  • impersonate another person or organisation;
  • deceive users about employment, services, casting or payment;
  • misuse SCOPIYA leads or contact information; or
  • circumvent agreed SCOPIYA fees through dishonest conduct.

SCOPIYA may restrict or suspend access where necessary to protect users or the platform.

14. PLATFORM AVAILABILITY

SCOPIYA may add, modify, suspend or discontinue features, categories or services as the platform develops.

Website access may occasionally be interrupted because of maintenance, technical problems, security issues or circumstances beyond SCOPIYA's reasonable control.

15. CHANGES TO THESE TERMS

SCOPIYA may update these Terms as the platform develops or as legal or operational requirements change.

The latest version and update date will be displayed on this page.

Changes will not automatically alter a separate commercial agreement already entered into between SCOPIYA and another party unless that agreement permits such changes or the parties otherwise agree.

16. ACCOUNT CLOSURE

Users may request closure of their SCOPIYA account.

SCOPIYA may restrict or close an account in cases involving misuse, fraud, violation of these Terms, security concerns or legal requirements.

Closing an account does not automatically cancel obligations or rights that arose before closure.

17. COMPLAINTS & SUPPORT

For support, complaints or questions relating to SCOPIYA, contact:

Please include your registered email address and, where applicable, the relevant job, service, talent or casting reference.

Do not send passwords, OTPs, banking credentials or other account-security information by email.

SCOPIYA will make reasonable efforts to review and respond to genuine complaints and support requests.

18. GOVERNING LAW

These Terms shall be governed by the applicable laws of India.

Nothing in these Terms is intended to remove or restrict any consumer right, statutory right, legal remedy or protection that cannot lawfully be excluded.

Users retain access to remedies available under applicable Indian law.
